Copyright & DMCA Policy

SmartPlate, operated by 410 LLC (“SmartPlate”, “we”, “us”), respects the intellectual-property rights of others and expects the same of everyone who uses the service. This policy explains how copyright owners can report material they believe infringes their rights, how the person who posted it can respond, and what happens to repeat infringers. It works alongside our Terms of Service.
1. What we publish
A recipe’s functional content — its ingredients, quantities, steps, times, and yields — is not protected by copyright, and that structured layer, together with attribution and a link back to the source, is what we make public. We do not republish source photographs, page scans, or a third party’s expressive prose. We do not republish a third party’s source photograph as the public recipe. A photo the household captured is stored for that household (private to them), not shown as the public dish. If you believe a recipe on SmartPlate nonetheless reproduces protected material of yours, use the process below and we’ll act promptly.
2. How to send a takedown notice
If you are a copyright owner (or authorized to act for one) and believe material on SmartPlate infringes your copyright, send a written notice to our designated Copyright Agent (Section 4) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work you claim has been infringed (or a representative list, if multiple works are covered by one notice).
- Identification of the material you claim is infringing, with enough detail for us to locate it — including the URL(s) of the recipe page(s) on SmartPlate.
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
Incomplete notices may not be actionable. Please note that under Section 512(f) you may be liable for damages if you knowingly materially misrepresent that material is infringing.
3. What we do with a valid notice
On receipt of a valid notice we will expeditiously remove or disable access to the identified material — either suppressing the recipe entirely or reducing it to a link-only stub that keeps the title and a link to the original source while hiding the body. We may notify the person who posted the material and give them the chance to respond with a counter-notice.

5. Counter-notice
If your material was removed or disabled and you believe that was a mistake or misidentification, you may send a written counter-notice to our Copyright Agent (Section 4) that includes all of the following, as required by 17 U.S.C. § 512(g):
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which SmartPlate may be found), and that you will accept service of process from the person who filed the original notice (or their agent).
If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
6. Repeat-infringer policy
In appropriate circumstances and at our discretion, we will disable or terminate the accounts of users who are repeat infringers. We track valid takedown notices against the account that posted the material; an account that accumulates repeated, uncontested infringement notices may be suspended or terminated in accordance with our Terms of Service.
